PRIVACY OBJECTIVE
Portland General Electric Company (“PGE”) believes the confidentiality of customer information is extremely important. PGE values our customer relationships and recognizes that when you provide personal information to PGE, you trust PGE to protect this information. PGE is committed to safeguarding the privacy of individuals and businesses with respect to nonpublic, personal, and financial information. This Privacy Policy addresses information obtained directly from PGE customers, website visitors, and mobile application users or other interactions with PGE. This policy explains PGE’s privacy practices – the information we collect and how it is collected, used, shared, and otherwise processed, the choices you can make about the collection and use of information you submit through our services, and our commitment to protecting your personal information. DEFINITIONS
"Personal information" means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include publicly available information, de-identified or aggregated information, or information covered by certain federal and state laws.
"You" means any Oregon consumer, PGE customer, website visitor, or mobile application user.
PERSONAL INFORMATION PGE COLLECTS
Account creation and maintenance. When applying for electric service or managing your PGE account, whether through our web service, mobile application or through our Customer Service department, PGE will ask for certain information such as your name, service address, mailing address, phone number, income details, and place of employment. In this process, PGE will also collect some form of more personal information, such as your date of birth, Social Security Number, driver’s license number, or other government issued identification numbers. In certain situations, you may provide health information. We use this information to provide you with our services, carry out requests made by you, maintain your account, support communication preferences, operate our business, and to otherwise communicate with you. We may provide this information to service providers and contractors, regulatory authorities, and financial services entities or to other third parties as required by law.
We will provide access for you to create an online account using your email, ID and self-selected password. The account will allow you to login to the PGE’s Website and mobile app, and to modify or update your account data. You shall be solely responsible for the confidentiality of your ID and password and for any authorized or unauthorized access to the Website by any person using your ID and/or password. You agree to notify us immediately of any unauthorized use of your password, ID, or any other breach of security discovered by you.
Payments. When submitting payment through our web service, mobile application or Customer Service department, your payment information is collected (e.g., payment card details such as payment card number, expiration date and security code, bank routing, zip code and account number) for payment processing, some of which is collected and stored by our third-party payment processor on PGE’s behalf. We use this information to process payments for our services.
Your communications with us. We collect personal information from you such as email address, phone number, or mailing address when you request information about our services, register for our newsletter, request customer or technical support, or otherwise communicate with us.
PGE may collect voice recordings or chat transcripts when you interact with our Customer Care team or chat with us.
PGE programs. You must also provide certain information to participate in certain PGE programs, including but not limited to, details about your home, such as: dwelling age, size and type, details about appliances and other energy-related equipment used in the home or building. Please see the specific program details to understand what information may be gathered by that program and how that information may be used by PGE.
Surveys. We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information which may include personal information.
Social media content and reviews. We may offer forums, blogs, or social media pages. Any content you provide on these channels will be considered “public” and is not subject to privacy protections.
Registration for sweepstakes or contests. We may run sweepstakes and contests. Contact information you provide may be used to reach you about the sweepstakes or contest and for other promotional, marketing and business purposes, if permitted by law. In some jurisdictions, we are required to publicly share information of winners.
Conferences, trade shows and other events. We may collect personal information from individuals when we attend or host conferences, trade shows, and other events.
Utility meters and other equipment. When you use electricity, energy usage data is collected by our metering systems. For some applications, such as rate analysis, we link usage information with your personal information.
Website automatic data collection. We may collect certain information automatically when you visit PGE’s website. This information may include your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, details about your browser, operating system or device, location information, and Internet service provider, pages that you visit before, during and after using the website, information about the links you click, and other information about how you use the website Information we collect may be associated with accounts and other devices. In addition, we may automatically collect data regarding your use of our website, such as the types of content you interact with and the frequency and duration of your activities.
Mobile application data collection. PGE’s Mobile Application collects certain data automatically, such as: the type of device you use, device identifiers, such as the resettable advertising identifier assigned to your device, the IP address of your device, geographical data such as the location of your device, your operating system, Wi-Fi mac address in your area, the type of internet browsers you use, data connection status and success/failure of connection, and data about the way you use PGE’s Mobile Application, installed applications on your device, and other data as reasonably required by PGE to enhance our services.
Geolocation information. When you enable location tracking on your device, we may collect precise location information. PGE may also obtain geolocation information on photos that you submit to PGE. We collect this information to provide you with our services and to better tailor our services to you depending on your geographical region. We may provide this information to service providers, contractors, regulators or to other third parties as required by law.
Cookies, pixel tags/web beacons, analytics information, and interest-based advertising technologies. We, as well as third parties that provide content, advertising, or other functionality to us, may use cookies, pixel tags, local storage, and other technologies (“Technologies“) to automatically collect information through our website and PGE’s Mobile Application. Technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that allow us and our partners to record certain pieces of information whenever you visit or interact with our website and PGE’s Mobile Application. We use cookies to evaluate website usage, provide energy services to you, and to offer programs and/or services that you may be interested in.
Analytics. We may also use Google Analytics and other service providers to collect information regarding visitor behavior and visitor demographics on our website and PGE’s Mobile Application.
Information from other sources. We may obtain information about you from other sources, including through third party services and organizations to supplement information provided by you. PGE may supplement your information with additional information we receive from a credit check performed when you apply for utility service or certain PGE programs. We may also purchase or otherwise acquire personal information from third party consumer data suppliers/resellers, data enrichment providers and aggregators, advertising networks, data analytics providers, internet service providers, operating systems and platforms, data brokers, business contact databases, government entities, and our parent, subsidiaries, affiliates, and other related entities. We may combine personal information we collect with information that we obtain from these sources. We will treat any such combined information as Personal Information.
Social Media. We may provide social media features that enable you to share information with your social networks. Your use of these features may result in the collection or sharing of information about you by the social networking website. Please review the privacy policies and settings of social networks you use to understand their practices.
PGE’s USE OF YOUR PERSONAL INFORMATION
Provide, maintain and improve our energy service products.
Manage your information and accounts and communicate with you regarding our services and other products or services that may be of interest to you.
Undertake research.
Operate and maintain safe, secure, and reliable public utility services and equipment under PGE's legal obligation to serve you as a regulated public utility in Oregon.
Comply with a valid warrant, subpoena, or court order, or exercise or defend legal claims or otherwise comply with our legal obligations.
Comply with an Oregon Public Utility Commission request order or comply with a request or order from other local, state, or federal governmental agencies with legal authority to obtain the personal information from PGE.
Measure interest and engagement with our services, and develop and implement marketing, education, and outreach plans to improve the services and products we provide to you and other consumers.
Detect security incidents and protect against fraud, theft, other crimes, and threats to safety, and prosecuting those responsible for that activity.
Enable service providers and contractors to provide services, products, or equipment on behalf of PGE.
Work with collection agencies on collection efforts.
Assist non-emergency and emergency responders in situations of threats to life or property.
Comply with PGE’s legal and financial obligations and for any other business or lawful purpose reasonably anticipated within the context of PGE's relationship with you.
For any purpose for which we obtained your consent.
Creation of de-identified and aggregated information. We may use personal information and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our services, or other analyses we create.
How we use automatic collection technologies. Our uses of these Technologies fall into the following general categories:
Operationally necessary. This includes Technologies that allow you access to our website, applications, and tools that are required to identify irregular site behavior, prevent fraudulent activity and improve security or that allow you to make use of our functionality;
Performance related. We may use Technologies to assess the performance of our website, including as part of our analytic practices to help us understand how our visitors use the website;
Functionality related. We may use Technologies that allow us to offer you enhanced functionality when accessing or using our website. This may include identifying you when you sign into our website or keeping track of your specified preferences, interests, or past items viewed;
Advertising or targeting related. We may use first party or third-party Technologies to deliver content, including ads relevant to your interests, on our website or on third party sites.
Cross-device tracking. Your browsing activity may be tracked across different websites and different devices or apps.
Notice regarding third party websites, social media platforms and software development kits. PGE’s website may contain links to other websites, and other websites may reference or link to our website or other services. These other websites are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.
DISCLOSING YOUR PERSONAL INFORMATION TO THIRD PARTIES
PGE may share or disclose your personal information in the instances described below. PGE does not and will not sell your personal information.
Consent. You may authorize other companies or persons to receive your personal information from PGE, including your energy usage data.
Service providers. We may share any personal information we collect about you with our third-party service providers, vendors, contractors, and agents. The categories of service providers (processors) to whom we entrust personal information include IT and related services; information and services; payment processors; customer service providers; and vendors to support the provision of electric services. We contractually require service providers acting on PGE's behalf to take reasonable steps to protect your personal information and to not use your personal information for any purpose other than that for which it was given to the service provider.
Regulatory authorities. We may disclose your personal information to regulatory authorities such as the Oregon Public Utility Commission, and other federal, state, or local agencies as required by applicable law.
Energy Trust of Oregon. At the direction of the Oregon Public Utility Commission, PGE shares select customer information with Energy Trust of Oregon (“ETO”). This information is used for designing, evaluating, and improving ETO services for energy efficiency and renewable energy systems and for marketing purposes. ETO is obligated under OPUC regulations to protect PGE customer information, including name, address, and energy-use history, and keep it confidential. Professional advisors. We share personal data with our legal, financial, insurance and other advisors in connection with corporate transactions or in connection with the management of all or part of our business or operations.
Financial and audit services entities. We may disclose your personal information to financial institutions, credit agencies, and other services entities that provide financial and auditing support services for our public utility programs and services.
Fulfill legal obligations. From time to time, we may disclose your personal information with other parties as required by any applicable law, regulation or legal process, pursuant to a valid legal warrant, subpoena, court order, or other legal or regulatory mandate, or as necessary for PGE to defend to assert legal claims.
Third-party analytics companies. We use selected third parties to collect data about how you interact with our website and apps. This information may be used to, among other things, improve the functionality of our website and services.
Advertising partners. We may allow third party advertising partners to set Technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, mobile identifiers, page(s) visited, location, time of day). We may also combine and share such information and other information (such as demographic information and past purchase history) with third party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party websites within their networks. This practice is commonly referred to as “interest-based advertising” or “online behavioral advertising. We may allow access to other data collected by the Services to share information that may be useful, relevant, valuable, or otherwise of interest to you. If you prefer not to share your personal information with third party advertising partners, you may follow the instructions below.
Disclosures to protect us or others. We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.
SWEEPSTAKES, CONTESTS AND PROMOTIONS
We may offer sweepstakes, contests, and other promotions, including promotions jointly sponsored or offered by third parties. If you voluntarily choose to enter a sweepstake, contest, or other promotion, we collect your information and may disclose it to co-sponsors and other business partners, such as for posting a winners list. By participating in a promotion, you agree to the official rules or terms and conditions that govern that promotion (“Promotion Terms”). Promotion Terms may include personal information handling practices that are different from what is described in this Privacy Policy. If the practices described in Promotion Terms differ from the practices in this Privacy Policy, the Promotion Terms govern but solely to the extent of the differences between the Privacy Policy and Promotion Terms. Please review the relevant Promotion Terms carefully before you participate in any promotion.
DATA RETENTION
Our retention periods for personal information are based on business needs and legal requirements. We retain personal information for as long as is necessary for the purposes described above. We also retain personal information as long as necessary to comply with legal obligations, resolve disputes and enforce our agreements. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired.
YOUR CHOICES AND CONTROL OVER YOUR INFORMATION
Profile and settings. You may update some aspects of your account information and adjust your account settings by logging into your online account. You may not be able to change your account information that is tied to aspects of active services provided to you (such as your email address). Some changes may not be made in certain platforms or take some time to take effect.
Email and telephone communications. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding us and our services, and you will not be able to opt out of those communications (e.g., communications regarding the services or updates to our Terms or this Privacy Policy). We process requests to be placed on do-not-mail, do-not-phone and do-not-contact lists as required by applicable law.
Text messages. You may opt out of receiving text messages from us by following the instructions in the text message you have received from us, visiting our website, or by otherwise contacting us.
Mobile devices. We may send you push notifications through our mobile application. You may at any time opt- out from receiving these types of communications by changing the settings on your mobile device. We may also collect location- based information if you use our mobile applications. You may opt out of this collection by changing the settings on your mobile device.
Cookies and interest-based advertising; tracking technologies. You can choose not to permit tracking technologies, such as cookies and web beacons, when you use PGE’s website or mobile application, but blocking some types of these tracking technologies may interfere with your experience. For instance, we may not be able to recognize you as a returning customer or save your preferences. You may be able to disable tracking technologies using your web browser settings.
Google Analytics opt out. To opt out of Google Analytics cookies, visit Google’s My Ad Center and/or download the Google Analytics Opt-Out Browser Add-On.
OREGON CONSUMER PRIVACY ACT
The Oregon Consumer Privacy Act (“OCPA”) provides for certain rights for Oregon Consumers (“Consumer” as used in this Section). These rights include:
The right to access personal data that has been collected about them.
The right to obtain a copy of their personal data.
The right to correct inaccuracies in their personal data.
The right to have their personal data deleted (if possible).
The right to know a list of the specific third parties that have received their personal data or any personal data from us.
The right to say “no” (to opt-out of) a controller using a Consumer’s personal data for marketing activities.
A Consumer has the right to request that we disclose what personal information we collect, use, and disclosed related to him or her. See Submitting Requests (below) to exercise these rights.
We will collect, use, and disclose information as provided in this Privacy Notice.
PGE does not and will not sell a Consumer’s data.
A Consumer has the right to request the deletion of personal information that we hold related to him or her. See Submitting Requests below to exercise these rights. However, as applied to the services we provide, this right does not apply where we need to retain the personal information to do any of the following:
Provide goods or services to the Consumer;
Detect or resolve issues security or functionality-related issues;
Comply with the law; and
Carry out any actions for internal purposes that the consumer might reasonably expect.
PGE does not and will not sell a Consumer’s data. Consumers have the right to opt out of the processing of your personal information by PGE for decisions that produce legal or similarly significant effects concerning you. We do not process personal information for such profiling. To opt out of targeted advertising, where applicable, please click the “Unsubscribe” link at the bottom of any email communication from PGE.

Usage data, e.g., information about content viewed or download, domain names, landing pages, browsing activity, dates and times of access, pages viewed, forms you complete or partially complete, search terms, uploads, or downloads, whether you open an email and your interaction with email content, access times, error logs, and other similar information.
Geolocation, e.g., city, state and ZIP code associated with your IP address.
Other information, e.g., any other information you directly provide to us in connection with PGE services.

Respond to comments, requests and questions and to provide customer service;
Send you administrative email and text notifications, such as security or support and outage advisories;
Send newsletters, surveys, offers, and other promotional materials related to our services and for other marketing purposes; and

Provide, process and deliver the services you request;
Improve the quality of experience when you and others use our services, including the customer service website and PGE’s Mobile Application.
Personalize your experience, for example, to:
Identify you as a user/customer in our system;
Personalize your experience with our Services; and
Develop, improve, and deliver marketing and advertising for the Services.
Secure our services and customers, for example, to:
Resolve disputes and/or troubleshoot problems;
Monitoring, preventing, and detecting fraud, such as through verifying your identity;
Combatting spam or other malware or security risks;
Detecting security incidents;
Debugging to identify and repair errors that impair existing intended functionality; and
Monitoring, enforcing, and improving the security of our services.
Defend our legal rights and compliance with the law, for example, to:
Comply with any applicable procedures, laws, or regulations and to protect our legitimate interests or those of others; and
Protect or exercise our legal rights or those of others (e.g., to enforce compliance with our Terms of Use, Privacy Policies, or to protect our services, customers, or others).
Commercial purposes, for example, to:
Tailor advertising to keep you aware of what we are up to and to help you see and find our products.

Third parties who engage in a legal investigation or in protecting or defending the rights or property of PGE or users of the services; and/or investigating or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use.

SUBMITTING REQUESTS
Should you as a Consumer wish to exercise an OCPA-related right, or contact someone for more information, you may do so one of two ways:
Requests to exercise the right to deletion, right to a copy, and/or the right to know may be submitted here or by contacting us at 800-542-8817 (toll free), Monday through Friday, 7am – 7pm.
We will respond to verifiable requests received from PGE Consumers or their authorized agents as required by law matching the information provided against the information, we have about you or requesting that you log into your account. A verifiable request must include the Consumer’s name, address, and account number (if possible). Any sufficient detail to allow us to properly understand, evaluate, and respond, is needed.
If we are unable to adequately verify a request, we will notify the requestor. We can verify an authorized party through the customer of records’ electric account documentation and/or through legal documentation. If we cannot verify the requestor’s identity from the information already maintained by us, we may require the relevant Consumer personally verify their identity and the authority of the authorized agent. This information will only be used for the purposes of verifying the requestor’s identity and for security or fraud-prevention purposes. The requestor can expect us to respond within the time limits set by the OCPA.
OTHER PROVISIONS
It is within our sole discretion, that we may revise this Privacy Policy from time to time. When we make any changes to this Privacy Policy, we will change the "Last Updated" date at the beginning of this policy.

SMS/TEXT MESSAGING
These SMS Texting Terms and Conditions (“SMS Terms and Conditions”) are applicable to individuals who have subscribed, consented or have otherwise been enrolled by Portland General Electric Company (“PGE”) to receive text messages (“PGE SMS Texting”) from PGE or its agents (those individuals hereinafter called “Recipient”). By accessing and using PGE SMS Texting, Recipient accepts and agrees to be bound, without limitation or qualification, by these SMS Terms and Conditions as well as PGE’s Privacy Policy and Legal Notices.
Text messages will vary in frequency. Recipient may request an additional text message that will include relevant contact information by replying “HELP” to the text message received. Additionally, Recipient may opt-out of PGE SMS Texting by replying “STOP” from their mobile phone. Recipient may receive one final confirmation text message from PGE stating that they will no longer receive text messages from that short code.
PGE offers PGE SMS Texting to provide information on topics including, but not limited to the following: Safety and emergency notifications, rotating outage information, outage restoration information, payment reminder, payment received, past due alert, disconnect notice, weekly usage, and subscribed to PGE programs.
Safety and outage information provided is valid only at the time the text message is sent and may change at a later time.
Age restrictions apply to PGE SMS Texting. In order to participate, Recipient must be 18 years of age or older and own and control the mobile phone number provided to us.
PGE’s SMS Texting only functions on certain devices and operating systems. Recipient acknowledges that future operating system upgrades to their device may or may not be compatible with PGE’s SMS Texting. Using password-protected mobile devices and enabling encryption, if available, is recommended.
Agreeing to the receipt of text messages is not a pre-condition for the purchase any product or service from PGE.
If Recipient is dissatisfied with PGE SMS Texting or with these SMS Terms and Conditions, their sole and exclusive remedy is to discontinue enrollment in PGE SMS Texting.
PGE reserves the right, in its sole discretion, to cancel or suspend any or all of PGE SMS Texting, in whole or in part, for any reason, with or without notice to Recipient. PGE may revise, modify, or amend these SMS Terms and Conditions at any time. Recipient agrees to review these SMS Terms and Conditions periodically to ensure that Recipient is aware of any changes. Recipients consent to receive text messages indicates Recipient’s acceptance of those changes.
RECIPIENT EXPRESSLY UNDERSTANDS AND AGREES THAT PGE AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, EMPLOYEES, PARTNERS, CONTRACTORS, CONSULTANTS, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE TO RECIPIENT FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF PGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE PGE SMS TEXTING, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, STATEMENTS OR CONDUCT OF ANY THIRD PARTY REGARDING PGE SMS TEXTING, OR ANY OTHER MATTER RELATING TO PGE SMS TEXTING.
PGE SMS TEXTING IS PROVIDED "AS IS." TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, PGE HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PGE DOES NOT GUARANTEE THE SUCCESSFUL DELIVERY OF TEXT MESSAGES. RECIPIENT ASSUMES ALL RISKS AS TO THE QUALITY AND PERFORMANCE OF PGE SMS TEXTING, INCLUDING BUT NOT LIMITED TO HEALTH RISKS. RECIPIENT ACKNOWLEDGES AND AGREES THAT THEY ARE SOLELY RESPONSIBLE FOR ANY DEATH, PERSONAL INJURY, OR ENVIRONMENTAL DAMAGE THEY CAUSE THEMSELVES, OR OTHERS, BY THEIR USE OF PGE SMS TEXTING. Messages sent via text may not be delivered if the mobile phone number is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of wireless carriers may interfere with message delivery, including the customer's equipment, terrain, and proximity to buildings, foliage, and weather. PGE will not be liable for losses or damages arising from (a) non-delivery or delayed delivery; and (b) inaccurate or incomplete content in a text or message.
Messaging and data rates may be charged by mobile service providers in addition to any applicable roaming charges. PGE does not impose a separate fee for sending messages. Content may not be available via all carriers. Carriers are not liable for delayed or undelivered messages.
